Drug crimes are divided into several different categories with Manufacture, Possession with Intent to Deliver, and Delivery and Distribution being more serious than mere Possession. Also, the amount involved determines the severity of the penalty.

In Texas, drug charges are divided into four different penalty groups with those drugs such as methamphetamines, cocaine and heroin falling into Penalty Group One, which is the most serious of all the penalty groups. Other drugs fall into lesser penalty groups and consequently the penalty for possession of such drugs is less severe than the penalty for possession or distribution of drugs in Penalty Group One.

Further, the severity of any drug crime is determined not only by whether you are accused of possession versus distribution, but also by the amount of drug involved with the larger quantity creating a more severe penalty.
